What You Should Know Before Using Our Sample Deed of Reconveyance
A borrower (trustor) receives this deed when he or she pays off the mortgage. This official document performs a few important roles:
- It confirms that the mortgage been paid in full
- It releases the borrower from the mortgage loan
- It transfers full ownership of the real property from the lender to the borrower
This document must be signed by the trustee (mortgage holder, title company). In Arkansas, Georgia, Michigan, Ohio, South Carolina and Vermont, it has to be signed by witnesses as well.
After the deed is signed, it has to be notarized and recorded with the county recorder (where the real property is located) within a certain time. This time limit depends on your state and the lender (beneficiary) may be fined if the deed is recorded late. Once this deed is recorded, the property will be clear of all liens.
